Before the Storm - Chaos and Hope in the System ☔️

Celebrating TPS Extensions while confronting asylum Inconsistencies.

As we approach the closing days of the Biden administration, significant measures have been taken to extend protections for many immigrants, offering a lifeline to those facing uncertainty. However, we must also acknowledge the incoming administration’s stated plans for mass deportations, some of which are reportedly already underway.

What lies ahead for our country’s immigration system? Will it be one of inclusivity and opportunity, or will it veer toward restriction and upheaval?

Let’s dive in.

Fighting for Fairness in an Unjust System

Despite media reports, individuals still arrive at the southern border seeking asylum. Many are detained and undergo a credible fear interview, the first step in determining if they can move forward with their claim.

But in my experience, the process is wildly inconsistent. Some clients wait weeks for a detailed, hours-long interview similar to an asylum hearing. Others are interviewed within days, asked a few basic questions, and released. And some even bypass the interview altogether!

This inconsistency makes it nearly impossible to offer clear guidance. Detention facilities operate with their own rules, adding confusion and unpredictability.

Take my client, for instance: she’s been detained for two weeks, and I still haven’t reached the ICE officer handling her case. My only contact with her has been limited to brief, cut-off calls. Frustration doesn’t begin to cover it. My priority remains ensuring her limited rights are protected and that she stays safe throughout this chaotic process.

This isn’t just her story - it’s a systemic issue. Bureaucratic inefficiency and poor communication undermine human dignity daily. Still, I’ll keep fighting, determined to be a voice for change.

Some Good News: TPS Extended

Just days ago, the Department of Homeland Security (DHS) announced extensions of Temporary Protected Status (TPS) for several countries, including Ukraine, Sudan, and Venezuela. TPS offers temporary protection to individuals from countries experiencing crises like war or natural disasters, allowing them to live and work in the U.S.

These extensions mean eligible individuals can renew their TPS if it’s set to expire, gaining additional time under the program. Why is this important? TPS grants work authorization and provides lawful status, ensuring recipients are not considered “undocumented” while their status is active. However, it’s important to note that TPS does not automatically lead to permanent residency or citizenship, a topic reserved for later.

This is undoubtedly positive news. However, I’m concerned that a program protecting vulnerable individuals could be at risk under the new administration. Practitioners must stay informed and remember that the future of this program depends heavily on who holds office.
